My employer filed I-140 on July 12th and at Nebraska Service Center which must have been deleivered by now. And my employer persist that they cannot file I-485 until I get receipt notice. I even came to know on another thread even without receipt notice I-485 can be filed with an application as a cover letter.
So can I do that myself without the help of the employer or I have to wait for the receipt notice.
Is there any way we can get the info by USCIS by calling them or by taking InfoPass Appointment and asking them..
Please advise. Thanks in advance.

A-7: Believe it or not, this is one of the most common questions I have received in the email. Without I-140 Receipt Notice and case number, there is absolutely no way you can file a stand-alone I-485 application. Assuming that you filed earlier and at least you found the receipt number through the cancelled check, it is still risky to file a stand-alone I-485 under the given circumstances. You can ask the USCIS "interfile to XXXXXX" without a copy of the pending I-140 receipt notice, but it is still not recommended. The option may be filing a new concurrent I-140/I-485. But predicament is lack of "original" labor certification. Service Centers have been denying such I-140 petition in a number of cases for lack of original labor certification application. The AILA may attempt to find an answer for this situation, but under the circumstances, you may not have any option other trying filing with the best evidence of I-140 petition filing proof including a copy of the cancelled filing check from the bank, federal or ups overnight delivery tracking record, complete copy of I-140 petition and supporting documentation, and I-485 application and documentation. It is better trying than doing nothing at this point. Or you can wait until first or second week to see whether you will receive the receipt notice of I-140 petition and file I-485 applicatiopn with this receipt notice. Inasmuch as you were eligible in July under the July VB, the extended period of I-485 application may work.

Not from last nights interview, but in primaries season during Politico's live interview on CNN Obama said this about legal immigration:
"It is important that we fix the legal immigration system, because right now we've got a backlog that means years for people to apply legally. What's worse is, we keep on increasing the fees, so that if you've got a hard working immigrant family, they've got to hire a lawyer; they've got to pay thousands of dollars in fees. They just can't afford it. It's discriminatory against people who have good character, but don't have the money. We've got to fix that. "
I know that's what he said but if you read that statement again, nowhere he talks about Highly skilled legal immigration. I think he is talking about the family based immigration, which again caters mostly to the Vote bank. From everything I have read, Obama seems to be anti-outsourcing and neutral (or maybe negative) towards highly skilled legal immigration

I applied end of March online at TSC. If they are approving within a month I would have got approval long back and not today. It is not coincidental they are approving so that they can give 1 year renewal.

I had the same question so I asked my attorney and he told me that you can "transfer" your H1B after Oct 1 and benefit from AC21, meaning that as soon as company B files an H1B petition for you and you have proof of this filing, you can start working for them.
However, I understand that you want to "transfer" before Oct 1, in which case company B has to file a new H1B petition either regular or with premium processing. This new H1B is not counted against the cap because you have already been counted against the gap in the 6 previous years.
In short, you should be able to work for company B starting Oct 1 if they file for a new H1B now and it is approved by Oct 1.
I recommend you ask an attorney for your specific case.

The mere mention of Fragomen makes my blood boil :mad::mad:. This law frim is the most useless in my opinion. They have no concern for their eventual client. My labor application was rejected :( because of the inefficient ppl at Fragomen. Their attitude was still so casual as if nothing happened. I am forced to use them but I would not recommend this Law firm even to an enemy.

This is yet another example of how the US is happy to tax us and let us finance Social Security, then place us in a similar category to "illegal aliens" when it suits them. I replied to the EB3_Nepa's first post saying that we probably should support killing this bill and try to attach our amendments to other bills.
And then I saw posts from others saying there were 700000 faxes from anti immigrant groups to kill the bill. And we barely managed to send some 10000 to 20000.
Like someone else said we seem to fighting their huge swords with our toothpicks. With a member strength of 14000, we will not be able to fight their web fax camaigns with any bill this year (even appropriations bills etc.).
So I come to this conclusion (which IV pundits probably arrived at long back) - the only way we can fight the anti immigrants is by aggressive lobbying. We have only 14000 members, but we together can contribute like we are a 700000 membership. And then we could think about hiring more than one lobbying firm if that helps, otherwise apply more pressure through the one we currently use.
This is the only way, I feel we can get anything done this year, because increasing membership takes a longer time than raising funds, and we dont have time!!!!

I am in a silimar situation stuck at PBEC. I haven't posted anything because people are quick to come and bash (as you noted - even if we are just venting frustration - like the rest of everyone a few days back). Yeah, life is unfair but some things further add to it.
