    I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

    Hi

    my GC job title is programmer analyst(15-1021.00), and curently working as a Sr.Programmer analyst using EAD with different company.

    Now they are promoting me as a Applications Project Lead, most of my job dutie are same as programmer plus some additional role.

    I dont know whether I can accept this promoton or not, I sent a mail to lawyer, mean while if any one of you have similar experience please advice

    Hi !
    My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

    Folks,

    I just realized that I forgot to add a piece of my employment history to the DS-160. I only realized it once I set up the appointment for H1-B stamping through VFS. I have all the corroborating paperwork (W2, paystub etc.) for that period. Do I need to re-do the DS-160? I already have an appointment and if I cancel the appointment and re-do the DS160 I might run the risk of not getting the date of my choosing. The problem is my existing company is a "successor in interest" of the company I forgot to mention. That is, I got my I-797 from this previous company.

    Please not that the facts in the existing DS 160 are true. It is just that I realized that there is a gap that I might have to fill.

    One of my friend had a problem in the recieved EAD card

    - they took an infopass appointment at the local center http://infopass.uscis.gov/
    - based on their advice - they sent another application without fees - and they corrected and sent a new EAD card

    I just got my H1 visa. As my understanding that they will stamp my passport at the port of entry, I wonder if they will keep my current I-797 at the port of entry (I already have the H1 stamp in my passport). Pls advise. Also, I don�t have the bottom portion of the I-94 on I-797 since I am currently in Malaysia . Would this be a problem? Please also advise if they will issue me the new I-94 at the port of entry. Anybody pls help. Thank you very much.

    I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
    I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?
    In this case whcih 140 number should I mention in my application and whcih center should I send the application to?

    I have filed the H1B(I129) transfer and extension on H4(I539) in the month of June 18th and then upgraded to premimum process in the month of November, after 2 days it got approved and within the next two days they changed the status to RFE and requested to send the paystubs for the past 3 months. I have all the paystubs and our attorney sent the response with the paystubs to USCIS. In between this my wife travelled to India when my I129 and I539 pending.
    1) Do you think there will be any problem for my visa to be approved(since my wife is in India)?
    2) Can my wife visa gets approved when she was in India?
    3) How long do they take to respond to the RFE?

    Please advice.

    If you new H1 is approved with new employer (for 1 year or 3 years) and if the 140 is revoked AFTER your new H1 is approved, then it wont affect your H1 and it will be valid thru its term.

    But if your old 140 is revoked, you will have to get new labor and new 140 going on before your new H1 expires.

    talk to a lawyer to make sure though.

    All,

    IV needs money for rally.

    Lets pledge to contrbute right after you get recpits.
    We all are skilled immigrations with high billing rates per hour.
    Think about how many hours you have spent tracking receipts,
    Lets not waste any more time in tracking, instead contribute a few hours to work and contribute some of that money worth to IV.

    Lets change one fruitless habbit to fruitful one.
