I came to US with H1 on Apr 2009. My wife who was working in the same company as I do, joined me on Dec 2009 with H4 visa. My H1 has expired on June 18 '10. I have applied for H1 extension much before and currently my status is pending with USCIS. Along with my H1 extension I have also applied for my wife's H4 extension. Her status is also pending.
My company has actually filed H1 visa for my wife for 2011 H1B quota.
I have the following questions, can someone kindly answer the same.
i) If my wife gets her H1 petition approved, should she travel back to my country to get it stamped and for her to work here in US?
Some say she should go back and some say she can start working here with her I797 notice, she can get it stamped whenever she goes to my country. Which is true?
ii) Assuming I get approval for my H1 extension and her H4 extension, should she get H4 extension stamped as well?
iii) Can she go for stamping for H1 as well as H4 in my country, if so which one should she go for first?

I need to apply for an extension for 3 more years, i get my first H1B from 10-04-2008 to 08-31 but i'm not sure about the process to extend my H1B, i dont now if i need re-enter in the visa lottery like the first time.
Extensions don't count against yearly cap numbers. So, you can apply for the extension 6 months before your current petition expiry (feb 2011).

Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
Since you know this point, I am sure the American Visa Officer working in various consulates, too, would know this. If not, send a copy of the law that says "Canadian citizens do not need Visa to enter US".

Given the Times Square bomber Faisal Shahzad�s immigration history, the common refrain of �let�s just close our borders to all immigrants� is (not surprisingly) becoming more vocal. Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

I may be ignorant here but why do you have 2 I-94s? Your I94 is invalid once you leave the country. So I would think the number on the latest and current I94 is the number you would use.

Previously , I was working in Kuwait. My H1B got stamped in Kuwait.
I didn't face any problem in the visa interview.
However, I don't know much about UAE.

you can claim him if:
1) He didn't earn more than $3500 in 2010
2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)
If you paid for his tuition, you may be able to claim tuition credits for him too.

what type of cases, you meant ?
I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

Hi All,
I have attended visa interview at US Consulate in Hyderabad for Blanket L1B.
I have answered everything very clearly and to the point. But, the VO told me that there will be some more information needed and she directed me to another counter.
There a guy gave me a form, I have filled my name, father's name, mother's name, education details, and employment history. Then I was issued a receipt, stating the Administrative Processing will be carried out.
How long will it take for this process?:confused:

Would appreciate the input on my querries by the attorneys & the people who has experienced similar situation.
My spouse's Advance Parole is expiring in mid February 2010. He is pplanning to travel to India by mid - jan & return back by 3rd feb'2010.
My questions is:
1) Is the time gap of 15 days before the expiry of the AP is safe to re-enter USA?
2) SHould he apply for the renewal of the AP before he leaves? If yes, then if the advance parole renewal approves before he re-enters the country, can he still re-enter on the old Advance Parole document or the old one gets automatically nullified?
3) Should he be in the country during the time the advance parole approves?
The situation is very urgent. Immediate feedback is highly appreciated.

On the EAD application form, Q15 asks for the current Immigration Status.
What will be the immigration status of a person who entered US on H4 visa but started working later using EAD?
Since I-94 has H4, Is it OK to mention the immigration status as H4/AOS Pending ?

APs are taking twice as much as EADs. Does anyone has any idea why?
