I was laid off in early April, and the employer told me that they would revoke my H1B 30 days later (early May).
Now finally I get a job offer. The new employer can start to work on my h1b now, but the starting date will be late July.
I have an EAD right now based on my approved 140 and pending 485 (>=180days)
I talked with my attorney, and he said I would definitely have to go back to re-activate my H1B abroad, so I should use EAD instead of doing H1B.
Is it true that I have to go abroad to re-activate my h1B? I saw some people transferred sucessfully
Any thoughts? Thank you very much.

just finished going thro all the proposed ammendments...only a handful (1154, 1156, 1166, 1183, 1200, 1220, 1242, 1249) deal with EB issues at all....very few of them are positive (3) for us.........also based on an article on immigration-law website, EB based people have no voice in the negotiations!!! so...as frusterating this may be.....its looking like a certainity that many of us will be screwed big time..........lets keep doing what we can through IV.......it looks all dooms though.........:mad:

You can enter all the data, save it and book your date as and when it becomes available. I did it recently for Chennai. But, if you do not book the date within one week of saving your forms, you have to enter the data once again. For Chennai, they normally open the dates 3-4 weeks in advance.

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

> Traveling to US on June-15, 2011
> Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011
1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?
Appreciate any inputs on this.

When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.

I do not see a country cap (10%) anywhere in this bill?

Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision.
