We applied on 8th Aug for AP; Got receipts with receipt date of 13th Sep from NSC. I got my AP approved on 14th Nov. but we are waiting on My wife's AP since. Haven't received it.
So we are planning to get our H1/H4 stamped and travel without AP. My Lawyer thinks it shouldn't be a problem

Until 2003 end most the people have filed 485. It all started when the cases were moved to BEC. Most of the cases were from 2004 and some from 2003/2/1/0. But eventually BEC cleared and some applied before 2005 Jan. So the dates moving forward for EB-3 India in next few months would be little by little roughly as below.
OCT 2007 - USCIS will start from 2003 Jun
NOV 2007 Dec 2003
DEC 2007 Mar 2004
JAN 2008 Jun 2004
Once it reaches Mar 2005, it is going to stop for long time. I have no idea on the mess created by USCIS, but it is going to be tough for immigrants, especially from India.

Lets all try to send this letter. I'm working with my HR to get this 7001 out - As Pappu said there should not be any reason why HR wont sign that form.

All numbers available to these categories under the FY-2007 annual numerical limitation have been made available
simple means that
all visa number (for FY-2007) are used up. They were made available to USCIS by DoS.

Hi Folks-
We (5 People) work for IBM company, SFO, today we went personally to the congress men and we submit the letter which is provided in this forum and after that we called state senator office and we explained about our problem. We faxed and email the letter to the senator office, staff had taken my contact details and they told me that they will inform the solution in 2days.

This is an excellent thread. It's something I've been looking for for a long time. I am still not clear about using AC21. Here's my situation.
July 2nd filer. Received EAD for me (primary) and my spouse. Waiting for I140 approval. I understand it's risky to invoke AC21 before I140 approval. After I get it approved, here's what I intend to do.
1. Inc a business in my spouse's name.
2. Invoke AC21 and join my spouse's company as a "Software Engineer" (my position in LCA)
If I do this, during I485 adjudication, all I need is an offer letter from my spouse company saying that I am working as a Software Engineer right?
Also, does USCIS care during I485 adjudication whether I got paid continously while employed with my spouse's company?
If for any reason, I decide to quit my spouse's company before I485 adjudication and move to a different company, Will I be able to do this?

I can organize weekly Conf. call, but I would need some initial input from IV Core Team about its activities. I also need to understand what were SoCal chapter targets and if any progress has been made. Maybe 485Mb4001 or Amit can guide on this?

If anyone else wants to come forward pls. do so and take charge. Communicate with the northern CA foks and organize a combined call or seperate call. We need someone to take a leadership role in this chapter at this time. Contact each and every member in this thread and bring them together to work on IV agenda items as outliined on the link on IV homepage for chapters.

Thanks for the input. My labor was stuck in BEC. It was approved last september . I sent all the documents to my employer to file 140/485/ead/ap.He is still going back and forth on filing. MY h1extension got an rfe and he wants to wait for it to get approved and then file. I hope i wont retire before that. I am only 28 yrs short of that.When will we know the decision to the bill. I hope it passes so that he files my next stages.Can i file it with my h1 extension application pending.

2 tier filing as of now does not allow EAD. it is only to pre adjudicate cases for i-485. Also, it opens a whole bunch of other problems. please read related (old) thread to it on this site.
If as part of 2 tier filing, EAD is allowed, i am all for it. So, we are only asking to get EAD/I-485 filing as soon as I-140 is approved.
