    Don't get me wrong. There are so many good lawyers. I have talked to few of them who are reputed and didn't even charge me for my first call. However what I said above is based on this (http://immigration-information.com/forums/showpost.php?p=18642&postcount=9). If you read entire thread, you would know what I meant.

    So one MUST ALWAYS keep EAD in hand till 485 is adjujicated.

    This is a very interesting find. But lets keep doing more research until we are concrete about whats the best option

    For all those who have sent PM.... Please note I am not an attorney or accountant... But then I had consulted my account and few attorney's ( paid the required fees to get them answered)... So please use your own judgement/caution.

    1. Yes you can open a LLC singly or jointly with your wife/friend/anyone.

    2. You can start the LLC even when you are on H1B but it is better that you wait till you get your EAD to get oprationalized. reason very very conservative view is that you cannot even write a check for your company or deposit a check... but this is a very conservative view....

    3. To open a LLC you can use an accountant ( if you have one, it will be cheaper by a couple of hundred dollars) or use agencies like www.legalzoom.com/legalzip/LLCs/llc_procedure.html .... I have used both in the past....

    4. Intially you can just form LLC as single or joint partnership and then elect as S corporations for taxing.... I forget within which period it is to be done, if I correctly remember when you file your first tax return or within 6 months you need to elect as filing as single person entity( then it becomes like your personal income) or you could elect as S corp....

    5. You will a tax id for the LLC, business license and other documents when you form a LLC, You will need to maintain book and tax records for 3 years... best to have it managed by an accountant

    6. You/ your spouse can work for your LLC.... Some of you if you want to after 180 days change employers can move into your LLC and maintain that you are employed in same occupational duties for your own LLC...

    Well, so far so good for me. As per Zillow estimate, my home value is now 10k more than my purchase price. It depends on where you're buying.

    I guess that when the economy starts climbing up and people starts buying houses, interest rate will also climb up to 6%. At 6%, I need to pay $400 more per month.
    If you check interest rate trends for the last 50 years, You will notice that during every economic downturn which is every 5-7 years the interest rates do come down. Although this time the down is a bit more due to severe recession, If you notice even in the last downturn around 2002 was in the 5% range. So only buying a house on the basis of low interest rate may not be prudent.

    One month is a small time span to check the value. If lets say one year from now your house loses value by 6%, The money you would save by taking a 6% loan on a lower principal will be higher than the lower interest rate on a 6% higher principal you pay now. You can always refinance again during the next downturn when the rates may again go down. But you cannot change the original principal at what you bought the home.

    So My point is the original principal you pay to buy the home should be a more important factor in buying a home than the low interest rate.


    I think you must have considered everything and made a smart choice, and this is not pointing at you. This is just a data point for others who haven't bought yet to consider.

    Looks like 10 years experience is required for individuals applying under "Exceptional Ability".

    They are targeting the wrong cases. They should have made the eligibility for EB1 Intercompany transfers harder by putting in more restrictions. Every tom dick and harry are eligible for the EB1 route. I know of many cases where the individuals are paid less than 70k and are processed in EB1 even though they have less than 10 yrs experience ,using the term multi-national executives. No offense on these individuals, but its not fair to impose restrictions on highly qualified compared to the EB1 Multinational route. JMHO

    Boxer , Feinstein senators of CA , I called Lofgren , Gary miller (R) 42nd district of CA and Just spoke with NYtimes reporter on the follow up story ...:)

    I already done that yesterday evening: Today I talked to both offices. Yesterday I just sent web form (E-Mail)... I could not speak to senators personally as both were unavailable but I spoke to their office staff and both have listened me and have guranteed to make sure this reaches to senator's eyes and ears.

    Hi everybody,

    I want to know if somebody knows what is going on with Atlanta perm lab center?I applied in Feb 2007 for perm labor and I checked my staus online almost every day.In jUNE 2007 IT SAID ''CERTIFIED''.My lawyer was waiting for the paper in mail..I checked again the status in July 2007and it said ''In progress''.Can somebody explain for me why is like that? What advice do you give me?

    Ooh - you are right !!! It took me more time to write the above than it took 25 USCIS workers to approve 25,000 I-485's... (48 hrs X 60 mins X 25) / 25000 = 3 mins.

    They are thinking us dumb fools because we are immigrants and we have to accept whatever they say !!

    I doubt if anyone was denied. They have to approve anyone and everyone to meet the numbers.

    I guess the reason for moving back eb2 I dates is strategic. Since they have the whole year to use the 140 K visas, they might be trying to start the year conservatively, trying to honor FIFO.

    The aggressive movement of dates in last quarter was ONLY to prevent the visa number wastage.


    I think the reason for the retrogression in EB2-I is obvious.
    There are only 800 visas available for EB2-I for any given quarter (remember the 7% country quota). The spill overs from EB2-ROW and EB1 start only after few months.

    EB2-I will move after the DOS looks at the unused visa numbers from EB2-ROW and EB1, hope fully next quarter.

    There are no spill overs into EB3-I, so it won't move any time soon.

    Note: I am not commenting on USCIS approving cases with later dates before older priority dates.

    Following a one time contribution I signed up for $20 re-occurring (Jan 2007). I have discontinued that to go to $50 now! I think if anyone wants to THANK and appreciate the work all IV volunteers did, they should be do so by paying. No thank you cards no flowers....just reoccurring contribution!

    I reviewed my comment and I haven't wrote anything trashing another country and I didn't say that USCIS is bad. In fact, if you read carefully I am trying to defend USCIS from "Mirage's comments".

    I don't know what nationality you are, but, I am an Australian and I don't need to suck up to get my green card. I will get my greencard soon, probably sooner than you.

    In fact, there is a special immigration program "only for Australians" that allow me and my dependents to work and live in Australia indefinitely. That was signed in to law by the President last year, if you didn't know about that. I guess you got me wrong. Australia and America have good relationships as you know.

    I still would stress to thank America for giving me the opportunity to work and live and experience America.

    Please read my comments properly next time and be a little fair on your comments.

    No wonder you do not like people complaining about things not moving fast enough. Dude, you got to eat something to know how it tastes.

    If you are getting a GC sooner just because you are an Australian, you have no moral authority to preach people who are affected. This thread is not for you, you are welcome to visit other threads though.

    Hmm so I was quite worried about good old Section 502(d)(2) at first, but after re reading carefully, this may not be terrible. I (and others?) might have pressed the panic button a little too quickly.

    As I read it now (and I am NOT a lawyer), any I-140 petition adjudicated after the effective date of this legislation (Oct 2008 seems to be the popular opinion) will be rejected if the I-140 petition has a filing date after May 15th 2007. If this *only* applies to adjudication of I-140s and NOT to I-485s, this means that you would have to have filed your I-140 after May 15th and have it still pending by Oct 2008 .... 14 months for folks filing in the near future. This is quite unlikely, as it takes only a month or so for premium processing, and around 6 months for non-premium.

    Folks might get into trouble if they have a labor certification stuck in the BEC and it doesn't get approved for another 12 months or so...
