My case was completed at the NVC last year, this was when there were still schedule A visas. Then retro came in Nov. In June 2007, NVC asked to re submit ds230. Why did they ask to resubmit it if we weren't assigned a visa number yet? and now that there are no visas left for CP, our file gets stuck again, and when our PD becomes current, do we have to resubmit for the 3rd time our ds230.... So confusing......

You are absolutely right...
I think we need to emphasize the fact that typically guys who got stuck in BEC for many years are the same guys being effected again, as they just got out of BEC queue and filled concurently and now basically are stuck again, it is really ridiculous experience for this group of applicants, where as people who have applied in PERM or those who were able to get LC certified without getting into BEC have gone through the whole process relatively smoothly....
My 2 cents, based on my experience.

2nd Labor - 2004 - Company B (RIR) (no one knows where it went)
3rd Labor - 2006 - Company B (PERM)
Managed to get a seat in 07-2007 bus
Still sleeping in the bus. Don't know when I reach the destination.
Even if life ends before the journey completes, the corpse will continue the travel until it gets the GC.
(not sure if AC-21s are applicable for corpses)

We are one of those unluckiest ones; I changed my company 2 months before July fiasco and (EB2 PD Aug 23, '06) and never got a chance again to file I-485.
It is very frustrating (to say the least) to wait and it seems it may take another ~2 years to file I-485. It is hard on my wife in particular as she completed her masters in 2008 and narrowly lost jobs offers because companies do not wanted to H1b transfer these days.
I do not see any hope of this agony end anytime soon :(

Just wanted to let you know that I received my refund yesterday. My wife and I filed a joint return. We both have SSN's. Just relax folks if you filed your taxes you will receive the refund. I had hoped the money could have been put to better use but oh well the politicians know better.

Mark my words...when apply to renew your EAD and you are not sure if spouse can work when one EAD has expired and the other is in the process of being approved you will realize what we are trying to say...after you keep applying to renew AP/EAD 3-4...one beings to wonder if it was all worth it.
In short, after we file our 485/EAD/APs we should work with IV and try to lobby for better laws...we should not be complacent and think our work is done, we crossed a small hurdle thats all.

The 7% per country limit applies in the first two quarters independent of EB category. Hence the 2450.
Unless, of course you are again dividing that as 28.6% per category - suspect EB1 takes up 28.6% of the 2450...
Anyways, like several have pointed out, USCIS is beyond all this logic! :)

Yes, it does. So it's a vertical orientation and says "temporary visitor status expires mm/dd/yyyy" in red.

Has Any Senetor Brought An Amendment To Reinstate Ac21 Provison To Eliminate Country Quota(10%), If Demand Of Visas Is Less Than Supply? The Orignial Spector Markup Deleted This Provision From The Ina. This Is A Big Blow To Oversbuscribing Countries, Unless The Current Markup Is Modified Thro An Amendment.

If you are stuck at Atlanta PERM backlog center , please email your case number and explain them that your application has been pending for a LONG time and request them to help us get out of this grave situation. Also, please post on this thread after you have sent an email so that others can be motivated to do the same. We need to send as many emails as possible to get any positive feedback. I know that DOL mentioned that they will start processing our applications soon, but we need to keep up the pressure from our end so that it has some positive effect.
I know most of the people on this forum are not in this situation ..... but let's see how many can come out of this selfishness and help others by emailing / phoning DOL Atlanta to help other brothers who want to file AOS just like them...... When phone campaigns / email campaigns happen .... we who are stuck at Atlanta help others tooo... so let's see how many on this form help us now...

We have to differentiate ourselves from the illegals. Let the illegals do Rallies, Huger strikes etc.
I agree. All this Gandhigiri is not going to do anything. Guys lets just stick with lobbying and reduce what we ask for like I mentioned on another thread. As long as everyone gets SOME benefit we should be good.
Too much of these fasts and rallies is going to do just one thing, it will send a powerful message of the WRONG kind to the American people that "First they come on temporary work visas, then they forcefully demand Permanent residency". It will affect us even more when we go back for visa interviews and also new people coming here will have problems. Also, unfortunate but true, IV is still viewed as an organization For the Indians, By the Indians, even though this is Not true at all. If you add the whole Gandhigiri aspect to it, it will only add more fuel to the hate fire that most anti-immigrants now have against some of us Indians.
By all means let us send a card every week to the Senators and Congressmen asking for help. A nice personalized card to each one of them EVERY week. Other than that let us PLEASE not entertain thoughts of "non-co-operation" and "Hunger Strikes". Let us remember Gandhiji was fighting to get OUR OWN country back from the FOREIGN British Rule.
