Not sure I follow you. How are we getting 50K spill over visas?
How we are getting 50k is like this.
1) EB1 Over Flow (50% of EB1 was unused last year) 46k/2= 23k
2) EB2 Over Flow , this number is still fuzzy. But lets say around 10k.
3) EB2 India has quota of 3500.
So approx 40k.

Are uou IT manager or working in non IT field. If you are in IT and non manager then doors are closed for you to go to Canada.
If you have plans of doing an MBA in future, then Canada would be a better option than US. Otherwise as uma001 points out, doors are closed for most professions except 38 occupations.

not be as simple as H1 renewal. G325 is pretty important form. The information provided on it is wrong. They could treat it as falsifying document.

I am one of the several may be thousand who have been affected. I am not using this for my slefish purposes. I am trying to get the suppoprt of IV and its members for this cause. I am not disagreeing with IV in any way.
This is an agenda for a common cause for all affected people and I want everyone to support.

Finally, I got the PIO card. It did not take long after sending a $20.00 MO, I got the PIO card in about a months time. The total time it took me was about 2 and 1/2 months...although they claim the processing time would be at the max. 45 business days.
The PIO card looks pathetic. Its hand written and the passport like book looks too cheap. Crap looking PIO card.
I saw the new PIO processing fee, includes the return postage, which is a good thing. No more calls to anybody asking to send again the postage fee...seems to me the Govt. of India, plugged this little hole.

December Visa bulletin is obviously frustrating for all of us. After the recent accomplishments in July visa bulletin and the tons of approvals that we saw after that, we hoped that everything will be alright.
But that did not happen. Some of us in the community were taken by surprise, but this was expected. Afterall there are only 140K greencards available every year. EB2 for India and China is already used up for the quarter. EB3 is badly retrogressed for everyone.
Believe me, it will not get any better. It will get worse with time if there is no immigration reform.
IV can only do what its members empower it to do. If members want us to be just a site for question and answers for individual visa problems we can stay like that. If members want us to come together and do a rally in DC, we will help organize it. We did a rally in DC on Sept 18 and made great progress. However we cannot just sit back and admire one effort. We need to continue it and capitalize on it.
Now is the time for everyone to decide if they want a greencard. If you need a greencard, and want to do something about it, then you must join this effort and help yourself by helping everyone.
Our Plans
Our next hope is year end bills. If we can get some provisions in those bills we can certainly look forward to a happy new year with fast movement of visa dates. Next year is an election year and it will become much tougher for any immigration bill to pass. We will need to make super extra push next year for something to happen. So the time to act is NOW.

For example, if someone's Advance Parole document validity is terminating on (say for ex), July 16, 2009, then, should the person apply for renewing his/her application prior to July 16, 2009? In other words, should a person's application to renew his/her AP document be made prior to the termination of the current one, OR, could this application for renewal be made after the current AP document's validity expires (in this case after July 16, 2009)? "My wife's employer filed for her GC during 2007 August rush for all of us. Her case is in EB3 with Feb 2005 PD. My labor is approved and filed for I-140 about a year ago and still hasn't been approved. Now, my PD is current based on yesterday's Visa Bulletin. Can I file another I-485 for me with a pending I-485 thru my wife's employer?"

yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.
OR, you can wait, and once your 140 is approved and provided your PD is still current, you can transfer your wife's 485 to yours making you the primary and the wife the dependent.

If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.
My plan was to see if I can upgrade to EB2 with the same employer. My attorney just shut my hopes down this afternoon. Per my attorney, the job description has to differ by atleast 50% if I were upgrade from EB3 to EB2 with the same employer. I guess it is hard to prove that Principal Software Engineer's job description and Software Engineer's job descriptions differ that much.
At this point I have not other option but to wait it out. I cannot move to a new employer and refile in EB2 because of valid reasons.

I am sorry you feel like that about IV core. I am not a CORE member so I can't speak for them but if you have spent a basic amount of time following and more importantly taking part in IV initiatives you would not have "decided" that IV is promoting "EB2" agenda simply because there is no such agenda.
I am sure you noticed this but if not, this is a free speech and membership forum and IV is not made up by pappu or paskal but each and every one who tries to make some difference by participating in the action items.
If you think that there needs to be IV initiatives that better suit your needs, you know what...lead it...set up action items....organize like minded folks. IV is setup for that. It is easy to just point fingers and put out statements based on your negative perception, if you really feel so bad about this phantom EB2 agenda, how about doing something constructive through IV.
