    First off i take offence to my spouse being called a "Skill-Less Free Rider". That is by far the most offensive and ridiculous thing anyone has said about H4s. Most spouses on H4 are neither skill-less nor are they here solely for their Green Cards. Infact there are cases where the H4 is More qualified than the primary H1 applicant in their own field, just that it is not an H1b type field or there is no H1B quota etc.

    It would be great if the moderators can please remove such offensive stuff when they get a chance. It is one thing to have freedom of speech and it is another to abuse that freedom.

    If L2's can work then why not H4s is my simple point. I wonder if we can ask for these kind of smaller reliefs from the law-makers.

    The basic idea behind this approach is to channel all the negative energy into something positive.
    Here is what me and my wife are doing. When the retrogression first hit us in 2005 January we were both devastated even more so because one my friend and his wife, with same the same priority date as ours and similar EB3 RIR got the Green Card on 24 Dec 2004. We would not have been so frustrated if they had the priority date even a month or so before us. But some are just lucky I guess. Coming back to what we are doing. My wife started her masters and finished in May this year. She could have finished in December but we were really banking on the CIR in May so she took more courses and finished it faster. Well that did not happen so whats next. So now I will be starting school again for second Masters this time MBA from one of the top10 B schools in January 2007. Ideally I wanted to do Full Time because its shorter duration as compared to part time but GC God (I wish there was one like that so that I can do the "Nariyal Pooja" or "Mundan" or "Abhishek") had otherr wishes so I have now switched from full time to part time. Lets see if my part time MBA of 4 years wins the race or Green Card wins the racce against time.
    Moral of the story. Channelize your energy into something positive and get masters or second for that matter, or learn a new language, enroll in classes to learn languages that run for 6 months at community classees by the time you get your GC you will know atleast a dozen languages.

    I know these are good ways to keep our mind off the gc, but for most of us who have spent 9 -10 years waiting and have family responsibilities, the steam of further studies has ran out especially if you have to pay for it yourself.

    I have had this query before. I had an H1B stamping on my passport for a company I never worked for. (Company A)

    But, when I applied for a H1B for a different company (Company B). My lawyer asked me if I ever worked for them and received any salary from them ... this was a RFE on my H1B case.

    All I did was replied to my lawyer with a negative answer to both questions (worked, salary for Company A).

    I got my new H1B approval I guess within 30 days of that RFE reply.

    You might want to contact a lawyer to draft a reply to USCIS though. I do not have a copy of the letter to provide to you ... Sorry!

    I think for Indian EB-3s, if your priority date is after March 2002, it is definitely worthwhile to do the conversion. Chinese EB-3s with priority dates after Sept. 2003 should definitely convert too.

    Even considering the time to find a job, file a new labor and I-140, it still looks like that you will get your GC faster than waiting in a not-moving line. The recent history has shown that the visa bulletin can get stuck for a specfic cutoff date for half a year. Besides, EB3s have been and will always be of a lower priority just as someone said in other posts.

    Good morning,

    If you pay a closer attention, I don't start threads. I just reply to messages following that topics you started. The real issue is that many members in this forum are so biased that you cannot take a different view.

    For example, yesterday many in this noble forum became so uneasy and angry as soon as I mentioned that shift from democrats to republicans was triggered solely by the disatisfaction with the Iraq war. It turned out that Bil O'Reilly last night said the same thing. That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.

    What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take the greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. I feel a need to provide this forum with another view, which many times I believe is the correct one. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

    If you are working for fortune 500 do not assume that you are safe if you are on H1. WHAT WOULD YOU DO IF THERE IS AN AMENDMENT WHICH WILL CHANGE THE FACE OF H1?

    02/14/2009: Tough Times Ahead for Professional Foreign Workers in EB-Based Nonimmigrant or Immigrant Journeys

    The just relased arrests and indictments of eleven people for H-1B frauds by U.S. District Attorney in Iowa may not be taken as an isolated event or incident. It is a signal showing government's determination to crack down abuse of the employment-based nonimmigrant and immigrant proceedings for the purpose of alleged protection of U.S. workers' jobs. This is a union-backed government. Besides, current economic crisis allegedly mandates the government leaders to take an action to protect American workers' jobs. No one will be in surprise to see Senators Durbin and Grassley reintroducing sooner or later their H-1B and L-1 reform legisation which they introduced last year but failed to make it before the last Congress closed at the end of 2008. The H-1B and L-1 reform legislation will mandate the agencies' reinforcement of enforcement activities against the abuse of such visas and tighten the threshold requirements for these visas in a line similar to the TARP-funded employer H-1B rules. Reinforcement of enforcement actions is soon to be made easy because of the two developments. One is reengineering of agencies's filing system and database in a direction of "account" system for each involved employer, each representative, and each alien worker, allowing detection of violation of the rules easy. The USCIS has been pushing such reengineering process in the form of electronization of filing of petitions and applications using "account" system and building such database. The DOL has also been working on such reengineering and is scheduled to implement it beginning from May 2009 for H-1B labor condition application filing using new ETA 9035 form which is designed to accomodate such account system and dababase and from July 2009 for PERM labor certification application filing using new ETA 9089 form which is also designed to accomodate such concept. The other development that makes the government's enforcement activities easy is electronization and data-sharing system among different agencies and their database. Electronization of the processes makes such data sharing available and easy among the related agencies. Expansion of E-Verify programs allows the Social Security Administration to participate in such enforcement process. Timing of release of recent indictment of evelen alleged H-1B visa fraud offenders is in a way not just a coincident.
    The Chief of DOL Division of Foreign Labor Certification, Dr. William Carlson, released as recent as February 2, 2009 that in the first quarter (October, November, December 2008) of FY 2009, they completed about 4,500 PERM applications, but in one month of January 2009 alone, they completed about 3,500 applications. But don't get excited about this statistics. He cautioned that the processing times would slow down as they feed into adjudication process investigation of unemployment conditions in various labor markets, increasingly turning cases into so-called "supervised recruitment" process considering worsening labor markets and rising unemployment. When the agency posted the supervised recruitment Q&A on its website quite some time back, we speculated that it was intended to send out a signal that they would increase supervised recruitment cases ahead. It has turned out that it was not just speculation. Worse yet, the Chief stated that once a case is turned into a supervised recruitment track, there is no set processing time implying that it can take time and time. When the PERM system is already clogged bad, the information is indeed depressing. On top of all of these, the newly designated Republican Commerce Secretary who was known to be a H-1B program supporter all of sudden backed out from participation in the Obama administration. Year 2009 may be marked as a difficult year for foreign workers, particularly professional foreign workers.

    Advantages of applying AOS when PD is not current
    1. No H1 extension needed (especially these days believe me its a nightmare)
    2. No visa Stamping needed (BIG BIG Night mare)
    3. spouse can work
    4. Dont have to worry about LCA blaw blaw blaw. especially after seeing the recent arrests
    5. during layoff do not have to start GC process (in this case AC21 can be used)
    6. WE CAN CHANGE TO EAD WHEN ANTI IMMIGRANTS CRY ABOUT H1 AND IN THIS ECONOMY DO NOT SURPRISE IF H1 IS COMPLETELY SCRAPPED.
    8. Can do two jobs at a time (in this economy its difficult, but this is possible if you are using EAD)
    9. You can work for TARP Companies (There are about 360 bail out banks... so you can work for any of these banks if using EAD)
    10. BIG ADVANTAGE... IF YOU ARE APPLYING EARLY IT IS VERY MUCH POSSIBLE FOR DHS/CIS TO DO ALL THE BACK GROUND CHECK/NAME CHECK WELL IN ADVANCE. AS AND WHEN A VISA # IS AVAILABLE, IT CAN EASILY BE ASSIGNED TO THE APPLICANT. THIS WAY CIS CAN BE EFFECIENT AND WILL NOT WASTE VISA's

    Again I do support others who say that AC21 job titles clause should be relaxed... All I am saying is one step at a time and more over there is a compaign already in progress.
    ALSO numbers really matter. There are lots and lots of my friends who are using AC21 with out any problem.

    Congratulations and enjoy your green card! Don't worry about the priority dates not being current when yours was approved. My green card was approved in September 2007, sometime after the July fiasco wherein the PD for all categories became unavailable. Since my gc approval, I've been in and out of the US, and I hadn't had any single problem getting back in.

    In my opinion, with this global economy - if the spouse is well educated and can work, there should be an opportunity for that person to work (atleast few hours per day).

    Excellent point. I think that the heart of the issue is that the immigration system in US is stuck in stone age when the needs of a knowledge driven, global economy are considered. Every visa category denied a job is seen as having an American having a shot at that opportunity. This is a short sighted view: people that can be launching companies etc are sitting and waiting for a decision from an inefficient, ineffective and outdated bureaucracy.

    But what do I know? I "knew the rules before I came here" :o

    1. Let us decide how we need the data. ie what query USCIS has to run

    2 make publicity of this .. ie uscis is an agency which should have the data but it is asking us to pay 5K for the data. (president, hillary clinton, aila and whoever else,...)

    3 Only getting this data one time wont help us. Like USCIS processing dates , they have to run our query every month on a particular date and publsh it. Otherwise after 6 months or one year we have to pay this money again.

    4 Can we appeal to the money asked by USCIS. Anyone who knows more about FOIA

    5 Can we request USCIS to give us the table details and tell them we can write the query/program free of cost.


    Any other suggestions..

    The first attorney that we had at Fragomen was so responsice and helpful and the second one rarely responds. It depends on the Attorney you get. In this case the better option is to have good replationship with your employer and ask your employer to request Fragomen for differnt Attorney. Our employer pays them lots of money and they have leverage.
