We have seen so much of visa retrogression all along.....I was thinking of the July fiasco...after effects....Just when i was thinking of How DOS advances the dates. It is really erratic...since they have no clue on the number of pending applications. While they want to advance the dates faster when they know USCIS will not be consuming all the 140K quota so they can have their overseas consulates process some of them in July it turned completely different More people opted for AOS v/s CP.... Wouldn't it make sense for them to have 2 different cutoff dates ?? 1 for USCIS and 2 for Overseas consulates . How will this help ? They can advance the dates more accurately. How does that affect the people already in USCIS queue...They can either choose to change AOS to CP. and since the dates are different on CP (better than that of AOS) this will make new people file more CP than AOS while a number of folks in uscis queue to move the CP route and hence relieve the pressure on USCIS. There will certainly be some disadvantages No EAD/AP etc when one goes the CP route v/s AOS but the wait will be minimal....

My company is processing my Green card and recently applied my I-140. My wife is applying for residency this year. Most of hospitals are saying that they can sponsor only a J-1 visa. Can you please suggest if this would be a problem for my Green Card processing and/or her visa stamping (Since applying for G.C means that we wants to stay and J-1 means the other way round)?

Hi all,
I have been fortunate enough to get one step closer to a green card.
I need to fill out form 230 and Line 25 asks to list all visits to or residence in the US.
I have been living in the US for the past 7.5 years. Can I just list my residences and corresponding visas or do I have to list all visits? :confused:
I have a fair number of visits, as I have been travelling both for work and leisure in the past few years. I have most of the entry/exit stamps, but there are a few missing. So I am wondering if there will be a problem when I list the visits and some of the dates cannot be supported with passport stamps.
Can anyone please advise if listing my residence will suffice (although this is already requested in line 20)?
btw I got my notification June 4, EU00006xxx

Good that the GOP nominee for the Senate in California is taking a centrist position, but its annoying to hear about being opposed to amnesty. My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?

I would like to invite my brother to US for a 2 month road trip I am planning in April.
I finished my employment in Jan and currently on 6 months B2 visa. I got my NZ residency approved and I will be leaving US in June at the end of road trip. I have been living in US for past 10 years (3 years on F1 and 6.5 years on H1B). I am 32 unmarried/male/Indian from Hyderabad.
My brother is 33 and is married with a 3 year old daughter. He manages my dads businesses (rental properties, finance, farm etc.). I am pretty sure he has some properties on his name.
I would like to know what are his chances of getting visa approved.
What do I need to provide him as support and what does he need to provide as support documentation ?? What does US consulate look for support typically and to what extent ?
I would really appreciate if anyone can give some advice especially someone who were successfully able to get a US visitor visa to their brother.

I got my EAD in 2007 and have been working for the sponsoring employer till now (Of course on EAD). Now I found a new opportunity w/ an excellent pay.
My designation and responsibilities at new employer are pretty much same as the current one but I see the difference in the salary --It is two times(2X) the current salary.
Is it OK if I accept this position with double salary?

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

The "A" number eventually becomes your GC number. It is not necessarily the Visa Number...we don't get to see the Visa Number.

A consultant in my project recently got his visa stamped in India. He didn't faced any issues. They didn't even ask for client letter. I guess he is just lucky :).

I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.

What is the difference been EB2 Vs EB2 NIW and when does one qualify for NIW
National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.
