I was on F-1 when I applied for I-485 (my wife was the primary applicant). My I-20 expired 6 months back, and I'm working on EAD. I'm planning to travel to India and use my AP for return. Will that be fine ?
What about my I-94 expiry ? I still have a 2 yr old I-94 on my passport, marked F-1/D-S.

Please be advised that the Nebraska Service Center (NSC) has been experiencing delays in the processing of I-765 EADs and I-131 Advance Paroles. Therefore, we recommend that EAD and AP renewals be filed 4 months prior to the expiration date, the earliest date USCIS will accept renewal applications. For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. Please contact our office for assistance with expedite procedures for your pending I-765 or I-131 application if your current work authorization is about to expire or if you have an emergent need to travel.

My fiancee is from Tijuana, Mexico and she has two children aged 11 and 14. They all have BCC laser visas, which allow multiple crossings into the US. I am a US citizen and live in San Diego, 25 miles from the border.
Here's my concern: her 14-yr old daughter will turn 15 on Jan 8, 2008, at which her BCC visa expires.
If my fiancee and I get married after the expiration date of her daughter's visa, and I file for the family-based adjustment of status I-485, will that affect our application process?
In other words, do my fiancee's and her children's BCC visas need to be current in order for their applications to be approved? Will the daughter's visa need to be renewed before we can move forward? :confused:

I came to US with H1 on Apr 2009. My wife who was working in the same company as I do, joined me on Dec 2009 with H4 visa. My H1 has expired on June 18 '10. I have applied for H1 extension much before and currently my status is pending with USCIS. Along with my H1 extension I have also applied for my wife's H4 extension. Her status is also pending.
My company has actually filed H1 visa for my wife for 2011 H1B quota.
I have the following questions, can someone kindly answer the same.
i) If my wife gets her H1 petition approved, should she travel back to my country to get it stamped and for her to work here in US?
Some say she should go back and some say she can start working here with her I797 notice, she can get it stamped whenever she goes to my country. Which is true?
ii) Assuming I get approval for my H1 extension and her H4 extension, should she get H4 extension stamped as well?
iii) Can she go for stamping for H1 as well as H4 in my country, if so which one should she go for first?

I am on H1B visa and just changed my job in September.
My H1B transfer (thru my new company) was approved and according to USCIS website, they have dispatched my 797-Notice of Action. But I am yet to receive those papers.
Now, I was on extension of H1B earlier (thru my old company), as my stamped visa expired.
Now, my spouse needs to visit India urgently. Can she travel to India with her old I-94 (the one that was stapled on the passport when she entered US the last time) and the other I-94 that she has with the visa extension papers ?? Of course, once we get the new Form 797, I shall also travel to India and we both will get our visa stamping done before we travel back to USA. Please suggest...

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.
The only reason iam planning to file h1b in 2-3 months from now is i dont have last 2months of paystubs as i was on vacation and other reason is my current project may be done in may or june.
So please advise me what is the best way to deal with the situation.

2. Company B applied for the H1B transfer which got approved.
3. Compnay B asked me to join on some particular date, because of some professional and personal reason I gave them the diffrent date but they told me either join on that particular date or do not join. Unfortuanaly I did not join.
4. Company B sent letter to USCIS for cacelling H1B visa. I never worked for company B

My question is theat I am working for A right now whether I am in valid status or not. I have EAD also.

I've received very good advice from IV members and hope to get this one sorted out here. My in-laws passed away within the last 2 years and wife's younger sister is stressed out. To cheer up we plan to bring her to US for 2 months. Her visa may get rejected for these reasons. No strong family ties in India since the parents passed away. She is an engineer (non-IT) but not employed and she is unmarried and no other siblings in India.
However she is a partner is her father's business and can show the documents as a proof.
What's the best way to get apply for visitor visa
1. I sponsor her visit, by sending bank statements, pay slips and employment letters etc.
2. She applies on her own and show her partnership documents, bank statements etc..
3. She goes through a travel agent like SOTC and book 10 day sightseeing trip and after which she could join us.
Obviously her sister being in US and no parents back home is a big red flag but we can't change that situation.
Any advice will be much appreciated.

H-1B employers need to be aware that June 30, 2009 will be the last day that the Department of Labor�s LCA Online system will be operational. As of July 1, 2009, all LCAs for H-1B and E-3 cases will need to be submitted through the iCERT portal (http://icert.doleta.gov/) and that means the end of instant LCA certifications.
This has very important implications for the timing of H-1B and E-3 applications as they relate to new hires and extensions. Employers will need to allow for delays in LCA certifications of at least 7 days rather than the instant certifications that were previously issued.

I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?
In this case whcih 140 number should I mention in my application and whcih center should I send the application to?

Hello,
this is a bit different maybe since it deals with my mom. She was sponsored by my sister. She has been stuck in name check now for about 18 monts. Anyways, she is out of the country. She just left, and now my sister got a letter and appoinment letter for a 2nd finger print. My mother is using her advacne parole and the green card was filed for adjustment of status.
so the questiong is can my sister reschedule the appointment 8 months in the future or can she change the location for finger print to the office in the country where my mother is,
She is in Pakistan right now.
