Hi this is my first post in IV ,i'm really glad to join this Community.
I'm on OPT right now ,i'm done with my masters in DEC 2007.
My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 18 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.
I did't apply in 2009 even i have chance to apply(because of the JOB fear ) my OPT extension is going to end in June 2010 , any way i will be applying H1b in 2010.
My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.
My Posti is too long but try to understand i'm student and can't efford going to a attorney for this sort of questions.

HI, i filed for my sons GC with an i-130. i received an I-797C saying it had been approved n a priority date of 02/26/2004. we have been waiting for years now i just checked the priority date and its already past that if im reading correctly its now at july 04...i am a US resident. i called the NVC but the automated service told me they are still processing visas from 1999?? What should i do?? can anyone give me decent advice on this? Thank you...

As Senate Democrats were preparing to go to the mattresses over Iraq voting procedures and as Republicans threatened to stop all activity over a judicial appointment, it's worth recalling what Senate leaders were promising at the outset of the 110th Congress.
On Jan. 4, incoming Senate Majority Leader Harry Reid (D-Nev.) declared on the floor that "last November, the voters sent us a message - Democrats and Republicans. The voters are upset with Congress and the partisan gridlock. The voters want a government that focuses on their needs. The voters want change. Together, we must deliver that change."
Minutes later, Minority Leader Mitch McConnell (R-Ky.) observed that "the challenges ahead will not be met if we do nothing to overcome the partisanship that has come to characterize this body over the past several years. A culture of partisanship over principle represents a grave threat to the Senate's best tradition as a place of constructive cooperation. It undermines the spirit and the purpose of this institution. And we must do something to reverse its course."
Six months on, the Senate has devolved into a nonstop brawl. The House, where leaders made let's-work-together promises of their own, also is a cauldron of partisanship, but at least there the rules permit a majority to rule.
But together, they've been able to pass just three pieces of significant legislation - a hike in the minimum wage, expansion of stem-cell research funding and a supplemental appropriation to fund the Iraq War. Only the first was directly signed into law. The second was vetoed by President Bush. The third was vetoed then passed.
Partisan warfare and inaction on issues from health care to immigration to energy - even lobbying and ethics reform, once the top priority for this Congress - has reduced respect for the legislative branch to its lowest level ever. Respect for the presidency is not much higher.
Who's to blame? Senate Democrats accuse Senate Republicans of "obstructionism" - systematic refusal to grant unanimous consent so that bills can be voted upon. Senate Republicans blame Reid for invoking cloture to stifle full debate and the offering of amendments.
The level of rancor is escalating now because Democrats are frustrated that Republicans are insisting on a 60-vote threshold on Iraq War amendments - as though Democrats in the past have not used the 60-vote requirement when it suited them. Republicans are threatening to create procedural chaos and allow little or no action on the floor if Democrats block a single appellate court nominee.
In January, Senators of both parties gathered in the Old Senate Chamber in what McConnell described as "a small act of bipartisanship" that he hoped would lead to a restoration of the Senate's reputation. Now, perhaps, Senators should regather there and contemplate their current level of public esteem.

My problem is
I am on valid L1 with company A and company B has applied for H1 for me. If my H1 gets approved
1. Can I continue to work on L1 with company A.
2. I want to go back to home country on vacation. If my H1 is approved can I go back to my home country and come back on L1?Do I need to get my L1 stamped again to enter back in US on L1? what will happen to my H1?
Please Advice.

I have filed for 485 /EAD and AP on july 2 2007
receipt date is July 2 2007
Notice date is Aug 29 2007
I see the processing time is 90 day at Texas
I called USCIS and they tell me that they count processing time from the Notice date and not from the date when the case was filed
We have travel plans for this Dec
Can some one pls guide me how and when i can get my AP soon

My friend Cyrus Mehta reports on a disturbing incident that occurred last week at Newark's international airport. Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?
New Approved H1B is enough.You don't need visa stamp again.

Hi,
I am in a situation where I changed my Job and new organization has filed the Visa Transfer process on 28 May 2010.
My and my dependents current H1-B / H4 and I-94 from the prior organization is expiring on March 14 2011 and the H1-B Transfer process has not been completed and rather it is now in the RFE Status as of Today i.e March - 7 2011.
Am I still eligible to stay in US or not. What should be my next course of action.
Please suggest at the earliest.

If you can wait for AP to get approved that would be a better choice. When did you applied for AP? I know couple of my friends whose AP got approved with in a month. It all depends on case to case. Don't take it granted as 2-3 month.

Hi All,
I am a bit concerned that my attorney wants to send the response to my RFE to the courier address for TSC rather than the po box listed on the gold sheet. Is this ok? Will the response reach the right place? They always use FedEx so they are saying that this is how they will send it.
People who had an EVL RFE on their 485 from TSC please respond.

- recently obtained a duplicate passport for my stolen passport, unfortunately also lost I-94 when received in Dec.08.
- Can I use the I-94 attached in the bottom of the I797? I won't have time to submit I102 and wait for replacement I-94.
- I've a trip coming very soon to Germany, last year had obtained the H1b stamping at US consulate in Germany, will it be ok if I apply for restamping at the same consulate because of time factor I'm not able to Canada or Mexico or India.
Any help and advise will be much appreciated. thanks !
