I dont know if people would be interested in discussing the implications of all EB categories turning current. Some of the points to discuss would be:
1) Processing times for I-485
2) Effects on future GC applications.

Folks,
I filed concurrently I 140 and I 485.
My application has been transferred from California to Nebraska.
I wanted to check if folks have seen any updates on thier cases.
I noticed on the website, for my I 140 status it does not show any date etc, it simply says case transferred to a USCIS office. For some folks it shows on a specific date..XX XXXX we recd your case at this office..
Can we all share our data under this thread for I 140 filing with 485 on July 2.

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

Any idea who represented skilled workers in the meeting that happened. I don't see Immigration Voice in the list.
Is IV core looking into how they can how they can be part of such meetings in future. If we are not represented, there wont be anything for us even in the comprehensive immigration reform. We employees cant rely on employers to represent us. That why we are where we are today.

Just Received a copy of my ETA 7089 from my HR. I learned that my Labor Cert may not have been properly filed.
The experience column
H6 - Is experience required in the job offered required for the JOB?
is NO
H14 - Specific Skills or other requirements says:
Qualifications include:
1) Five years of experience in Web Development ... and so on
H14 and H6 Contradict themselves...
My HR is dumb and the attorney had made mistakes for simple H1b filings in the past..

Guys,
I had received FP notice 2 days ago and my FP date is after 3 weeks. I was getting ready to try to do it early but I just received Card Production Ordered email for both my spouse and myself. What do I do now? Do I need to still go for the FP after 3 weeks.
I am not sure why they would send me the FP notice if they wanted to approve my GC.

Hi,
My parents are currently in the U.S. on their visitor Visa (B2) which has 10 yr validity running till 2014. Their visa was originally sponsored by my sister and brother in law. Now we would like to extend my parents current stay beyond the six months I94 and we want to file for an extension. However, the financial position of my sister has changed as she is out of a job now. Is it possible that we can show me (son) as a sponsor, showing my financial statements/pay stubs as proof of financial support? This might mean I am taking over sponsorship now though their 10 year visa was sponsored by my sister. Would this be a problem leading to rejection of extension, or worse, affecting the validity 10 year visa itself?

But I just submit I-765 (EAD) renew by 6/22/08. Now I found out my I-140 and I-485 are all approved. Can I revoke or withdraw I-765(EAD) from USCIS?

Recently my husband had received an RFE on I-485 requesting information about his employment verification letter. He had sent all documents back to USCIS and today, I saw an update on my case. The message read that case processing resumed and there will be a decision or update made in 60 days.
Do you know what kind of decision they usually make? Is it normal to have such statements written up for a denial or approval?
Any words of comfort would help. My husband is the primary applicant.

Hi,
My labor was denied first time through PERM(December 2005) and later after refiling, it got approve through PERM ( Applied on May 2006)
Now Can I use my first labor filing date as the priority date(Decmber 2005) or they will take the new date(May 2006).
I have I-140 Approved.

i am waiting for my priority date to become current to file for I-485. But it looks it'll take forever, as evident from May 09 visa bulletin, in which the visa dates are unavailable for EB3 India category. Do you know why dates are retrogressing or stagnant in bulletins after bulletins.
I have another question. My birth certificate is in an Indian language which was issued from the panchayat office where I was born. I want to know if that can be translated to English right here in US for I-485 application. Can somebody else who is not related to me write the translation in English and then get it notarized? If this is the case, then I don't have to go to India or get it done from there from the panchayat office, because this may take a long time. If anyone had tackled issues such as this, please share.

your lawyer. In many cases, the "most recent action by USCIS" counts. So your H1B gets approved and then H4 gets approved, the last action may count. That is why it is important that you consult a good attorney.
